Under the creditable coverage rules of the Health Insurance Portability and Accountability Act of 1996 (HIPAA), participants in group health plans are entitled to certificates of creditable coverage upon the loss of that group health plan coverage. The certificate provides evidence of your prior health coverage. You may need to furnish this certificate if you become eligible under a subsequent group health plan that excludes coverage for certain medical conditions that you have before you enroll. The certificate may need to be provided if medical advice, diagnosis, care, or treatment was recommended or received for the condition within the 6-month period prior to your enrollment in the new plan.
Your insurance carrier should provide a Certificate of Creditable Coverage when your coverage terminates. If you elect COBRA continuation coverage, you should also receive a Certificate of Creditable Coverage when your COBRA continuation coverage terminates. You and your covered dependents also have a right to request and receive a Certificate of Creditable Coverage from any insurance carrier or health care plan under which you or your eligible dependent had coverage Ė up to 24 months after coverage ceases.
If you are a participant in the United Welfare Fundís health plan and you are unable to obtain a Certificate of Creditable Coverage from our insurance carriers upon the loss of your coverage, the Plan Administrator will provide assistance to obtain the same from the insurance carrier.
